Regulation (EU) 2025/40 on packaging & packaging waste
On January 22, the Regulation (EU) 2025/40 on packaging and packaging waste, was published in the OJEU. In order to align the EU’s packaging and recycling rules with its bigger ambitions such as the Green Deal and the proposed Clean Industrial Deal, for which media reports recycling will be a core pillar.
The Regulation amended the Regulation 2019/1020 by introducing stricter rules and guidelines for the monitoring of packaging, to ensure compliance with EU environmental standards. It also amended Directive 2019/904 by limiting single use plastics, and repealed Directive 94/62/EC to reflect the EU’s updated rules on sustainability and the circular economy.
The Regulation speaks on conformity assessment related to packaging to provide a presumption of conformity. Not included in the regulation is mention of third-party conformity assessment (by Notified Bodies). However, the ‘Presumption of conformity’ in Article 36 refers to test, measurement or calculation methods. These are performed by CABs under accreditation in accordance with Regulation (EC) No 765/2008. Article 36 states that the tests, measurements, or calculations in conformity with harmonised standards are presumed to be in conformity with the requirements covered by those standards. If the tests, measurements, or calculations are carried out by accredited conformity assessment bodies, then it is assumed that they meet the aforementioned requirements. In addition, packaging that complies with harmonized standards that have been published in the Official Journal of the European Union are assumed to meet the requirements set out in the Regulation, considering that it follows the standards.
