EUROLAB's Position on the Markets in Crypto-Assets Regulation (MiCA Regulation)

EUROLAB is happy to present its position linked to the ongoing public consultation opened by the European Commission regarding the Markets in Crypto-Assets Regulations (MiCA regulation).

The EUROLAB position is that such evidence should remain governed by its sectoral and accreditation frameworks and outside the scope of MiCA, and that the Regulation and its review should make this explicit.

The position paper highlights the following key points:

  1. A clear separation between conformity evidence and any settlement signal is the sound organising principle, and MiCA's scope should reflect it.

  2. MiCA should state, as an explicit scope principle, that Quality Infrastructure bodies and their conformity evidence remain outside MiCA - and the settlement interface should be designed so that this holds in practice.

  3. Where the signal conveys a conformity outcome (rather than merely confirming that an assessment was carried out), the "verified" signal should not be transmitted as a simple binary outcome

  4. Conformity evidence is not static, and the Regulation should accommodate this.

  5. Accredited evidence warrants recognition as a first-class trust signal, established upon existing recognition arrangements.
